I am planning to study MBA in Texas. Graduated from one of the university in Texas and I am currently in H1-B. The university I am planing to go tells me that I have to have one year of H1B visa before getting out of tuition fee waiver. I heard and read online that Texas law provides out of state tuition fee waiver to H1-B visa status immediately ( like univ of Houston) and there is no such rule as one year (unlike washington state where 1 year of H1B is needed). I cannot find any written legal Texas code that states this. Does anyone have the link or know where I will be able to find it?  

The issue in this case is not whether you're an H1b or not.  It's just that in order to get in-state tuition, you need to be a texas resident. and for that you need to have stayed in tx for 1 year.  couldn't find anything official but - http://www.ehow.com/how_2318193_establish-texas-residency.html  .. In any case i think tx now is one of the few states where h1b and spouses can enjoy this benefit of in-state tuition. not too many states allow that.

I am in texas for a while now, but my H1 just started. They said my H1 has to be 1 year too. But I thought 1 year rule are for those who come directly for the employment. When I google it online, so many resources says that H1 can pay in state tuition in Texas (and it doesnot include the boundary of one year). But I just cant seem to find the one (offical copy) that I can email it to them....
